# Terms of Service > The rules for using SwapShoot: who can use it, what you may upload, what is banned, temporary storage, free and paid swaps, and our limits. - **URL**: https://swapshoot.com/terms - **Last Updated**: 3 November 2026 --- SwapShoot is an AI image-editing service for lawful, consensual creative photo editing, including adult content. These Terms govern your use of the SwapShoot website, web application and developer API (the **Service**). In these Terms, **SwapShoot**, **we**, **us** and **our** mean the operator of the Service. If you use SwapShoot for an organisation, you confirm that you have authority to bind that organisation. Our [Privacy Policy](https://swapshoot.com/privacy) explains how we handle personal data; accepting these Terms does not replace any separate consent required by law. ## 01 Eligibility and your account You must be at least 18 years old and legally able to enter into this agreement. Everyone depicted in an image you submit or generate must also be an adult. SwapShoot supports Google sign-in and passwordless email sign-in (a one-time link sent to your email). Provide accurate account information, protect your account, and tell us promptly if you suspect unauthorised access. You are responsible for activity you authorise through your account. Do not share access in a way that bypasses account or usage limits. ## 02 How the Service works You upload an image to edit and a reference image containing the head or likeness to use. The Service produces an AI-edited result. Results depend on the source images, model behaviour, capacity and the selected settings. Generation is automated. Our staff do not manually approve every result. You must inspect an output before downloading, publishing or otherwise using it. AI editing can introduce errors or unintended changes, including changes to clothing, product details, appearance or context. Do not use a result to misrepresent the actual characteristics of a product. The website's demonstration images may replay previously generated examples. They do not guarantee that your uploads will produce the same result, processing time or level of accuracy. ## 03 Your images, permissions and consent For **both** the image being edited and the reference image, you confirm that: - every person depicted is 18 or older; - you own the image or have the necessary copyright licences and other rights to upload it, allow its processing and use the output; - every identifiable person has given informed permission covering the proposed use of their image or likeness, including AI head or face replacement; - the permission covers your intended use of the result, including advertising, commercial publication or distribution where relevant; and - you have provided any privacy information and obtained any further consent required for the processing, including by making our Privacy Policy available where required. You must confirm these permissions before your first generation; that confirmation covers every image you upload from your account, and you must not upload an image it does not truly cover. Permission to possess a photograph, an image being publicly available, or someone being a celebrity does not by itself authorise use of their likeness. A model release or stock-image licence must actually cover the proposed edit and use. Keep appropriate evidence of your permissions. We may reasonably request relevant evidence when investigating a complaint or suspected misuse. Do not upload material if you cannot lawfully authorise the processing. Your confirmation does not remove responsibilities that applicable law independently places on us. ## 04 Prohibited uses Lawful, consensual adult creative edits are permitted under these Terms. You must not upload, request, generate or distribute through the Service: - sexualised or intimate edits of a person's likeness without their **explicit, informed permission for the specific edit and any intended publication or distribution**; - images depicting anyone under 18, including images used as references or targets; - nonconsensual use of a person's likeness, invasive imagery, harassment, threats, bullying, blackmail or defamation; - deceptive impersonation, false endorsements, identity fraud, fabricated evidence, or images misleadingly presented as proof that a person did something they did not do; - content that promotes violence or hatred, exploits people, or infringes privacy, publicity, copyright, trademark or other rights; or - content or activity that is otherwise unlawful. Authorised creative photo edits are permitted when they comply with these Terms and are not presented deceptively. You must not bypass safeguards, remove legally required provenance or disclosures, evade usage limits, access another user's data, interfere with the Service, introduce malicious code, or run unauthorised scraping or bulk automation. Do not sell or share account credentials or API keys, use an unpublished API without our permission, or extract or reverse-engineer our software or models except where applicable law permits it. Integrations may use the published developer API under the pilot supplement below. These restrictions do not limit rights that applicable law does not allow us to restrict. ## 05 Ownership and our limited processing permission You retain your rights in the material you upload. As between you and us, we do not claim ownership of your generated outputs. To the extent we acquire transferable rights in an output, we assign those rights to you, excluding our software, models and other pre-existing materials. You may use outputs for lawful personal or commercial purposes, subject to these Terms and any third-party rights. We do not guarantee that an output is exclusive, qualifies for copyright protection, or is cleared for every intended use. You give us and our service providers a limited permission to receive, temporarily store, process and return your content to provide the requested Service, maintain security, handle reports and comply with law. This permission does not authorise public display, advertising use, sale of your images or model training. It ends when the relevant content is deleted, except for any narrowly required legal preservation. We do not use your uploads or outputs to train or fine-tune AI models. Any future optional use would require a separate, clearly explained choice before that use begins. ## 06 AI disclosures and provenance Outputs are AI-edited. Do not present them as unaltered photographs where that would mislead someone or violate a legal, contractual or platform requirement. Keep any required AI label, watermark, content credential or provenance information supplied with an output. Make any further disclosure required for your use, including in advertising or publication. These user obligations do not replace any labelling or technical marking obligations that apply to us. ## 07 Temporary storage and downloads Routine website uploads and associated temporary processing files follow the website's **24-hour deletion window after upload**. Website Library outputs are kept for **24 hours after generation** and then deleted. Developer API inputs and results follow the separate pilot rules below and our [Privacy Policy](https://swapshoot.com/privacy). Download anything you want to keep; SwapShoot is not a long-term storage service. We do not operate a public gallery or user-to-user sharing feed for your uploads or results. Sharing a downloaded result elsewhere is your responsibility and remains subject to the permissions and restrictions above. Limited information may be retained longer when required by law or for a necessary complaint, security incident or legal claim, as explained in the Privacy Policy. Account, consent-confirmation, security and billing records have separate retention periods. We cannot retrieve an image after it has been permanently deleted. ## 08 Free swaps and paid swaps Swaps are open only to eligible accounts. Each account gets 5 free swaps; the first is clean, the next four carry a small SwapShoot watermark. Prices are on the [home page](https://swapshoot.com/#pricing); refunds follow the [Refund policy](https://swapshoot.com/refunds). We will not charge you for signing up or for your free swaps. For paid swaps, the price, currency, taxes, credit quantity, generation cost and any expiry will be disclosed before you purchase. You must authorise a purchase before you are charged. Credit-pack purchases are one-time purchases unless you separately and expressly choose a recurring plan. Credits are a limited right to use the Service, not money, a bank balance or an investment. They are not transferable or redeemable for cash except where law requires. If no expiry is disclosed at purchase, purchased credits do not expire while the account remains active. We will not retrospectively reduce the purchased credit quantity or impose an undisclosed expiry. Promotional credits may have separately disclosed conditions. Pricing changes apply to future purchases; any material change to the use of existing paid credits will be handled with appropriate notice and any remedy required by law. ## 09 Failed jobs, refunds and consumer rights If a request is refused before generation or fails because of a Service error without delivering a usable result, we will not consume a paid credit or will restore the credit charged for that request. Contact us if this does not happen correctly. A completed generation is not automatically refundable solely because you prefer a different creative result. This does not exclude remedies for a defective or misdescribed service, an unauthorised charge, or any other mandatory consumer right. If we permanently discontinue a paid feature so that you cannot use your remaining purchased credits, we will provide a reasonable replacement or refund the unused purchased portion, subject to applicable law. Any statutory cancellation or withdrawal right remains available. Where immediate supply of digital content or services requires your separate express request or acknowledgment, we will obtain it at checkout; accepting these Terms alone does not waive that right. For billing issues, email [team@swapshoot.com](mailto:team@swapshoot.com?subject=SwapShoot%20billing). ## 10 Reports and enforcement You can report suspected misuse, infringement or use of your likeness without an account. Describe the issue and provide a relevant link or job reference if available. Share only information necessary to assess the report; do not send illegal material. Send reports to [team@swapshoot.com](mailto:team@swapshoot.com?subject=Report%20misuse). We may reject requests, restrict or suspend accounts, disable access to content we control, and preserve or report information where required by law. We will handle complaints within applicable legal deadlines. We may act immediately for a serious safety, security or legal issue. Where reasonably possible and lawful, we will explain an account restriction and allow you to ask for review. We do not guarantee removal of downloaded copies held by people or platforms outside our control. ## 11 Changes, availability and account closure We may update the Service, impose reasonable usage limits, perform maintenance or discontinue features. We do not guarantee uninterrupted availability, a fixed processing time or error-free results. For paid services, we will honour applicable commitments and consumer remedies. You may stop using SwapShoot at any time, and delete your account from your account page in the app. Account closure does not cancel lawful outstanding payment obligations or require deletion of records we must retain. Refund and data-retention provisions continue to apply. ## 12 Our intellectual property The SwapShoot branding, website, software, models and documentation belong to us or our licensors. These Terms give you permission to use the Service, not ownership of those materials. Demonstration images and third-party materials may not be reused without the necessary permission. ## 13 Disclaimers and limits of liability To the extent permitted by law, the Service is provided "as is" and "as available", without additional warranties of accuracy, fitness for a particular purpose, non-infringement or uninterrupted operation. This does not exclude warranties or remedies that applicable law requires. To the extent permitted by law, we are not liable for indirect or consequential losses, including loss of profits, business opportunity or reputation. Our total liability arising from the Service is limited to the greater of **US$50** or the amount you paid us for the Service in the 12 months before the event giving rise to the claim. These exclusions and limits do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or any liability or statutory consumer right that cannot lawfully be excluded or limited. If you use SwapShoot for business purposes, you will indemnify us against third-party claims and reasonable costs arising from your unlawful content, lack of required permissions or material misuse of the Service, to the extent caused by you. We will give prompt notice, allow reasonable participation in the defence, and not agree to a settlement imposing obligations on you without your consent. This does not require you to indemnify us for our own wrongdoing or override mandatory law. ## 14 Governing law and disputes Governing law and venue will be stated here before general availability. If the law where you live gives you a non-waivable right to local consumer protections or to bring a claim in your local courts, those rights remain available. Please contact us first so we can try to resolve an issue. Contacting us does not restrict your right to a regulator, court or other remedy available by law. ## 15 Changes to these Terms We will publish updated Terms with a revised date. For material changes, we will provide notice before the change takes effect where required by law, using the Service or your account email. Urgent legal or security changes may take effect sooner where permitted. Changes do not retrospectively remove rights relating to a completed purchase. If you do not accept a change, stop using the Service and contact us about any remaining paid entitlement. If any provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. ## 16 Contact For general, legal, billing and misuse enquiries, email [team@swapshoot.com](mailto:team@swapshoot.com?subject=SwapShoot). ## 17 Developer API pilot supplement **API pilot supplement dated 2 November 2026.** API key creation is self-serve for verified, photo-confirmed accounts, with no admin approval or credit balance required. New uploads and generation require credits, an operational runtime and an account that is not suspended for new work. Published [API documentation](https://swapshoot.com/developers) and the [developer console](https://swapshoot.com/app/developers) do not themselves add credits or start generation. Existing held work, owned status/results and matching accepted replays remain available with valid credentials if your available balance reaches zero. Valid keys may still read previously accepted work while new admission is disabled; revocation, expiry or account closure ends that key's access. Use only the documented endpoints and the scopes, quotas and limits assigned to your account. Keep API keys on a server you control, protect them as credentials, and revoke a key if it may be exposed. Do not embed secret keys in public web pages or distributed mobile apps. You are responsible for the authorised use of your integration and for making required notices and obtaining informed permission from the adults shown in both photos, including when your end users supply those photos. The same content restrictions and photo checks apply to single jobs and every batch item. Choose Never expires, 30 days or 90 days when creating an API key. You may edit an active key's expiry without replacing its secret or changing its scopes; a dated choice starts from when you save. Existing keys keep their expiry until edited. Expired or revoked keys cannot be restored, and revocation or account closure still ends access for keys with no expiry. API jobs use existing credits only. One credit is held per admitted image and consumed when a result is stored for retrieval. Failed items release or restore that credit through reconciliation; a batch can have both successful and refunded items. Free swaps, referral rewards, subscription allowances and unlimited website administration do not pay for API jobs. Observe documented idempotency and retry rules rather than repeatedly submitting a new request after an uncertain outcome. API results have an 18-hour authenticated access window after successful settlement. Unclaimed uploads expire after 30 minutes; accepted inputs remain private while needed for queued processing. Access expiry and account closure trigger cleanup, but physical deletion can be delayed by provider operation or outages as described in the Privacy Policy. Job receipts and operational records have separate retention. Downloading after access expiry is not guaranteed and does not by itself refund an otherwise successful generation. The pilot provides queued single-image and bulk submissions, without a guaranteed completion time, availability SLA, inference batch size or GPU cost saving. Queuing may improve worker reuse, but bulk submission does not establish true GPU batching or a discounted credit price. Capacity, safety and delivery failures may end in a refunded item. Material paid commitments and mandatory consumer rights remain as stated above.
